## Overview

An **Assignment of Benefits (AOB)** is a legal document signed by a policyholder that transfers their insurance claim rights to a third party (typically a contractor, restoration company, or public adjuster). The assignee can then:
- File the claim directly with the insurer
- Negotiate settlement
- Sue the insurer for underpayment
- Receive payment directly from the insurer

**Controversy**: AOBs became problematic in states like Florida where they were allegedly used to inflate claims and increase litigation.

**Verification**: Each row below was checked against the cited statute or reported decision. Only **one state (Florida)** has a statute prohibiting property AOBs, and only for policies issued on/after 1/1/2023. Texas has **no** statutory ban; its restriction comes from courts enforcing policy non-assignment clauses. Oregon follows the majority rule and is **not** restrictive. North Dakota (N.D.C.C. § 26.1-39.2-04) and Mississippi (Miss. Code § 75-24-307, 2024) do not ban AOBs but condition post-loss assignments to residential contractors (co-payee only, notices, delivery to insurer).
