Property Insurance Claims Timelines Comprehensive Reference

Nationwide Sources dated Aug 2026 Download

Master 50-state + DC table of statutory and regulatory property claims handling deadlines: acknowledgment, investigation commencement, accept/deny decision, payment, and status-letter intervals, with the applicable day type (calendar, business or working days), catastrophe extensions, 'reasonably promptly' states, fastest and slowest timelines, statute-of-limitations notice requirements and a full regulation citation list. Every row was checked in August 2026 against the statute or regulation text and carries a citation. No rows are currently flagged as unverified.

Verification note (August 2026): every row checked against the current statute or administrative regulation text (state legislature and administrative code sites) and NAIC Model 902 where adopted; rows carry a citation/Source link. No states are flagged Figures in older metadata sections that conflicted with the verified table were removed. All master-table rows were verified against a primary source by the August 28, 2026 follow-up pass; none remain flagged.

Property Insurance Claims Timelines - All 50 States + DC

Purpose: Quick reference for statutory claims handling deadlines Last Updated: August 2026 (verified against statute and regulation text)

Important Notes

  1. "WD" = Working Days / "BD" = Business Days / "CD" = Calendar Days
  2. Many states use "reasonably promptly" without specific day counts
  3. Some states extend deadlines for catastrophe/disaster claims (see table below)
  4. Timelines may differ for health/auto vs. property claims — several figures previously listed here came from health-claim rules and have been removed
  5. Always verify current regulations - timelines can change

Verification: Every row in the master table links (Source column) to the primary statute or regulation that was checked. Cells reflect the text of that source as read; where a source sets no number, the cell says so rather than supplying one. Days are calendar days unless marked BD or WD. Where the official state site could not be fetched, the source link points to the reproduction that was used (e.g., Cornell LII), and confidence is noted in the second-pass verification note below.

Second-pass verification (Louisiana, Mississippi, New Jersey, New Mexico): These four rows were re-checked against official or reliable mirror text. Louisiana was read from the official legis.la.gov text of La. R.S. 22:1892 (§ 22:1973 is repealed, Acts 2024, No. 3, eff. July 1, 2024; the old 60-day rule no longer exists and no 90-day catastrophe figure exists). New Jersey was read from Cornell LII (nj.gov PDF still 404): the property decision deadline is 30 CD after POL, not 45. New Mexico's 90-day catastrophic figure is confirmed (§ 59A-16-20(F); 13.7.4 NMAC); no working-day acknowledgment figure exists, and 13.10.3 NMAC (previously cited) is a health rule. Mississippi has no numeric property deadline in § 83-5-45 or in Miss. Admin. Code Title 19 (mid.ms.gov itself could not be fetched; confidence medium).

Update/Status Letter Requirements

Frequency States
30 days CO (every 30 days after day 60), NV, NH, WA
30 WD / BD NE (30 WD), VT (30 BD, third-party only)
45 days AL, AZ, AR (45 CD), IA, KS, KY, MD, MO, NJ (45 CD), OH, OK (OAC; 60 days under § 1250.7), OR, PA, RI, UT, VA (45 CD), WV (45 CD)
45 WD AK

Event-based CA (30 CD), GA (notice within 5 BD after deadline lapses), IL (delay letter at 75 days from report or 25 days after POL), MN (10 BD reply to communications)
Not specified CT, DC, DE, FL, HI, ID, IN, LA (field adjuster report within 15 days of request only), ME, MA, MI, MS, MT, NM, NC, ND, SC, SD, TN, TX, WI, WY

Removed from earlier lists: IL, IN, KS, MN (no 30-day cycle); GA, SC (no 45-day cycle); TN (no 60-day cycle); FL (no 45-day cycle). Utah's status letters have no public-adjuster/attorney waiver — that exception applies to the SOL notice.

SOL Notice Requirements

State Notice Requirement

Alaska 60 CD before expiration
Arizona 30 days (first-party) / 60 days (third-party)
Kansas 30 days (first-party) / 60 days (third-party)
Missouri 30 days (first-party) / 60 days (third-party)

West Virginia 30 days (first-party) / 60 days (third-party) (§ 114-14-6.12)

Key Observations

  • Numbers previously borrowed from health-claim rules (CT, IN, NC) and figures with no basis in the cited text (CO 15/30/15 WD, IL uniform 30 days, SC 15/30/30/45, TN 30/60, NY 35 BD payment, OK 20 BD acknowledgment) have been removed.
  • Payment deadlines are less common than decision deadlines. DE, KS, MD, MO, NY, OK, OR, PA, and VA set no numeric payment deadline; they require prompt payment only.
  • Florida was tightened in 2022 (SB 2-A): 7-day acknowledgment, 60-day pay-or-deny, and no 45-day update cycle.
  • Interest rates: MI 12% (after 60 days from POL), MT 10%, ME 1.5%/month, WI 7.5% (no longer 12%), TX 18% plus fees after 60 days, WY 10% plus attorney fee for unreasonable refusal.
  • Day type matters: NE and AK count working days for everything; AL, UT, and VA are expressly calendar days.
