Notice of Claim Filing Deadlines

Nationwide Sources dated Aug 2026 Download

Master 50-state + DC table of claim notice requirements: initial notice standard, supplemental and reopened claim deadlines, date-of-loss rules for weather events, whether the state applies a notice-prejudice rule, and the governing statute or decision, with detailed sections on Florida's statutory notice deadlines, North Dakota's supplemental/reopened bar, Louisiana's immediate-notice rule, standard fire policy states, NFIP and Florida Citizens, consequences of late notice and best practices. Every row was checked in August 2026 against primary statute text or the controlling appellate decision, and rows carry a Source link. Most states rely on policy language ('prompt notice') rather than a statutory deadline.

Verification note (August 2026): rows checked against statute text on official legislature sites and controlling appellate decisions; rows carry a Source link. No rows are marked Rows whose Source is marked '(not confirmed from text)' (secondary source or citation located but official text not retrieved): Alabama, Alaska, Arkansas, Colorado, Delaware, District of Columbia, Georgia, Hawaii, Idaho, Indiana, Kentucky, Maryland, Mississippi, Missouri, New Jersey, New Mexico, Pennsylvania, South Carolina, South Dakota, Tennessee, Texas, Wyoming. All master-table rows were verified against a primary source by the August 28, 2026 follow-up pass; none remain flagged.

Notice of Claim Filing Deadlines - All 50 States + DC

Purpose: Quick reference for claim notice requirements, supplemental claim deadlines, and reopened claim rules Last Updated: August 2026 (verified against statute text)

Important Notes

  1. Policy terms may be shorter - Always check policy language for notice requirements
  2. "Prompt notice" is the most common standard - usually interpreted as reasonable under circumstances
  3. Weather event dates - Only Florida defines the date of loss for weather events by statute; every other state uses the date of occurrence
  4. Supplemental claims - Only Florida and North Dakota impose statutory supplemental/reopened claim bars; elsewhere policy terms govern
  5. Always verify current policy language and state law

Verification: Every row in the master table was checked against primary statute text or the controlling appellate decision in August 2026. Where the official text could not be retrieved and the cell rests on a secondary source or reproduced copy, the Source column is marked "(not confirmed from text)". Only two states (Florida, North Dakota) have a statutory day-count deadline for the insured's notice; in all others the "Prompt (policy)" or "immediate written notice" standard comes from the policy form or the statutory standard fire policy. Cells marked "—" mean the verified findings did not state a rule.

Louisiana - Immediate Notice

La. R.S. 22:1311(F) - Standard Fire Policy

  • Immediate written notice of any loss required by the statutory standard fire policy
  • No specific day count - "immediate" interpreted reasonably
  • R.S. 22:1892 governs insurer duties only (initiate adjustment within 30 days of notice, 14 days for non-catastrophe; pay within 30 days of satisfactory proof of loss); it sets no policyholder deadline and no storm-landfall rule

States With Statutory Standard Fire Policy - "Immediate Written Notice"

These states have adopted the 1943 New York standard fire policy (or an equivalent) by statute. The statutory form requires the insured to give immediate written notice of any loss and, where shown, to render sworn proof of loss within the stated period unless the insurer extends it.

State Statute Proof of Loss
Connecticut CGS § 38a-307 60 days
Iowa Iowa Code § 515.109 60 days
Louisiana La. R.S. 22:1311(F)
Maine 24-A M.R.S. § 3002 60 days
Massachusetts M.G.L. c. 175 § 99
Minnesota Minn. Stat. § 65A.01 60 days
Nebraska Neb. Rev. Stat. § 44-501 (1943 NY form) 60 days

Pennsylvania 40 P.S. § 636 60 days
Rhode Island R.I. Gen. Laws § 27-5-3 60 days
Virginia Va. Code § 38.2-2105 60 days

Related forms: California (Ins. Code § 2071) requires written notice "without unnecessary delay" and 60-day proof of loss; Missouri mandates the 1943 form by regulation (20 CSR 500-1.100); Arizona (ARS § 20-1503), Idaho (§ 41-2401), and West Virginia (§ 33-17-2) also adopt the NY 1943 form. Michigan repealed its standard fire policy (MCL 500.2832) effective 1992; MCL 500.2833(1)(l) now only requires the policy to state its notification requirements.

Prompt Notice Standard (Most States)

What Constitutes "Prompt" Notice

Courts generally interpret "prompt" or "immediate" notice as:

  • As soon as reasonably practicable under the circumstances
  • Within a reasonable time after discovery of loss
  • Without unreasonable delay

Factors Courts Consider

  1. Severity of loss - Major losses may justify slight delay
  2. Insured's condition - Injury/illness may excuse delay
  3. Type of loss - Hidden damage discovered later
  4. Insured's knowledge - When damage was/should have been discovered
  5. Prejudice to insurer - Did delay harm investigation ability

Typical "Prompt" Interpretations

Circumstance Generally Acceptable Potentially Late
Major disaster 30-60 days 90+ days without excuse
Standard loss 7-14 days 30+ days without excuse
Hidden damage From discovery Long delay after discovery
Injury prevents reporting Until able After recovery with delay

Statutory Notice-Prejudice Rules

State Statute Rule
Utah Utah Code § 31A-21-312 Late notice/proof does not bar recovery unless insurer shows prejudice; excused if not reasonably possible and given ASAP
Wisconsin Wis. Stat. § 631.81(1) Notice within 1 year after policy deadline does not invalidate claim unless insurer prejudiced and compliance was reasonably possible
Maryland Md. Code, Ins. § 19-110 Insurer must prove actual prejudice (liability policies by its terms)
New York N.Y. Ins. Law § 3420(a)(5) Prejudice rule applies to liability policies only; first-party property late notice can bar coverage without prejudice

Policy Language Examples

Standard HO-3 Language

"In case of a loss to covered property, you must...give us prompt notice of the loss."

ISO Property Form Language

"You must see that the following are done in the event of loss or damage to Covered Property: (a) Notify the police if a law may have been broken. (b) Give us prompt notice of the loss or damage..."

Common Deadlines in Policy Language

Policy Type Typical Notice Requirement
HO-3 Prompt notice
DP-3 Prompt notice
Commercial Property As soon as practicable
Inland Marine Immediate notice
NFIP 60 days

NFIP (National Flood Insurance Program)

60-Day Proof of Loss Requirement

Requirement Deadline
Notice of loss As soon as practicable
Proof of loss 60 days from date of loss
Extension Available upon request

NFIP Special Rules

  • POL is condition precedent to recovery
  • Extensions must be requested in writing
  • Late POL may be excused for good cause
  • Building and contents are separate claims

Citizens (Florida) Notice Requirements

Citizens Property Insurance Corporation

Claim Type Notice Deadline Statute
Initial claim 1 year from loss F.S. § 627.70132
Supplemental 18 months from loss F.S. § 627.70132
Reopened 1 year from loss F.S. § 627.70132

Consequences of Late Notice

Complete Denial Available When:

  • Policy makes timely notice condition precedent
  • Insurer can show actual prejudice from delay (in notice-prejudice states)
  • Delay was unreasonable under circumstances
  • No excuse for delay (injury, hidden damage, etc.)

Late Notice May Be Excused When:

  • Insured had reasonable excuse (injury, disaster chaos)
  • Damage was hidden and discovered later
  • Insurer not prejudiced by delay
  • Insurer waived notice requirement through conduct (e.g., Missouri: adjuster's appearance deems notice given and waives it, RSMo § 379.160)

States Requiring Prejudice for Denial

See the Prejudice Rule column in the master table. Notice-prejudice states require the insurer to show actual prejudice, such as:

  • Evidence could no longer be gathered
  • Witnesses no longer available
  • Property repaired/altered
  • Subrogation rights impaired

States Not Requiring Prejudice (Forfeiture Rule)

Alabama, Arkansas (where notice is a condition precedent), District of Columbia, Georgia (where notice is a condition precedent), Hawaii, Idaho, and New York (first-party property). Indiana and Iowa presume prejudice from unexcused late notice, subject to rebuttal by the insured. Illinois treats prejudice as one factor in a reasonableness test.

Supplemental Claim Rules

What Triggers a Supplemental Claim

  1. Additional damage from same peril discovered
  2. Additional costs incurred during repairs
  3. Hidden damage revealed during restoration
  4. Price increases affecting repair costs

Statutory Supplemental vs. Reopened Bars

State Type Definition Deadline
Florida Supplemental Additional damage/costs during open claim 18 months from loss
Florida Reopened Previously closed claim, additional costs for disclosed damage 1 year from loss
North Dakota Supplemental Additional amount for an element of loss already paid 12 months from insurer's last payment
North Dakota Reopened Previously closed claim 1 year from loss
All other states Either Per policy Policy terms

Weather Event Date Determination

When Is the "Date of Loss"?

State Rule Authority
Florida Hurricane landfall date OR NOAA verification of weather event F.S. § 627.70132
Texas Date property damage occurred Policy terms
All other states (incl. Louisiana) Date damage occurred Policy terms; no statutory landfall rule

Multi-Day Events

For extended weather events (multi-day hurricanes, prolonged storms):

  • Policy language controls whether the first date or last date of damage is used
  • Florida uses landfall date or NOAA verification

Best Practices for Claim Notice

Immediate Steps After Loss

  1. Document damage - Photos/video before any repairs
  2. Notify insurer - Call AND follow up in writing
  3. Get claim number - Document who you spoke with
  4. Send written notice - Certified mail, return receipt
  5. Note the date - Keep record of all communications

Written Notice Should Include

  • Policy number
  • Date of loss
  • Brief description of damage
  • Location of damaged property
  • Contact information
  • Request for claim forms

Timeline Tracking

Action Do This
Initial notice Within 24-48 hours if possible
Written confirmation Within 7 days
Proof of loss When requested (usually 60 days)
Supplemental claim As soon as additional damage discovered
