Important Notes

  1. Fee caps are statutory or regulatory maximums - contracts can specify lower amounts
  2. Emergency/Catastrophe caps apply only to claims arising from a declared catastrophic disaster or emergency, as defined by each state
  3. Bond requirements protect consumers against PA misconduct; several states set no statutory bond
  4. Policy-limits rules (NAIC model act style) bar a percentage fee when the insurer pays or commits to policy limits within a short window after the loss is reported
  5. Always verify current law - licensing requirements change frequently

South Dakota NOT REQUIRED South Dakota does not license property and casualty adjusters of any kind.

Every other state and DC (47 jurisdictions) requires a license. Idaho, North Dakota, Vermont and Wyoming were previously listed here in error; each has a public adjuster license (Idaho Code ch. 41-58; N.D.C.C. ch. 26.1-26.8; 8 V.S.A. §§ 4791, 4803; W.S. § 26-9-202).

Additional verified fee rules:

  • Florida: fee drops to 1% when the insurer pays or agrees in writing to pay policy limits within 14 days of the loss or 10 days of contract execution (F.S. § 626.854(11)(b)3.)
  • New York: up to 20% on a supplemental claim is permitted if the aggregate fee stays at or below 12.5% (11 NYCRR 25.7)
  • Connecticut: no fee if the insurer offers full policy limits in writing within 30 days of a fire-policy structure loss (CGS § 38a-726)
  • Kansas: no percentage cap; K.S.A. 40-5514 requires the percentage to be stated in the contract
  • South Carolina: time-and-expense compensation under the 5-business-day policy-limits rule is itself capped at 10% (S.C. Code § 38-92-130(C))

No PA-specific solicitation rule was found in Arizona, Hawaii, Indiana, Massachusetts (MGL c. 175 § 172; 211 CMR 92 not reviewed), Mississippi (commissioner may regulate solicitation by rule, § 83-17-527), Missouri, Nevada, Utah, Vermont, Washington or Wyoming.
